The Probate Process
The probate court must approve the estate of a deceased individual, giving the executor power over everything named in the estate. The process of getting the estate approved is probate. In the probate process, a lawyer must submit addresses, prove the Will in Solemn Form, expenses and liability to the court; request an order for land (if applicable) to be changed; file tax returns; pay out the estate; and do a final tax return.
